Marjan Peeters: The Complex Regulatory Context of Climate Litigation in the European Union

Marjan Peeters is Professor of Environmental Policy and Law at Maastricht University in the Netherlands, while being affiliated with the Maastricht Sustainability Institute, and the Research Institute of Environmental law at Wuhan University in China. Her research focuses on EU environmental and climate change law. In her presentation, she focused on the role of climate litigation in the context of EU emissions reduction legislation.

Alexander Zahar: Greenpeace v. Norway: A Leakage Case Litigated as a Human Rights Case

Alexander Zahar is Professor of International Law at Southwest University of Political Science and Law, Chongqing, China, and Honorary Professor at Macquarie Law School, Sydney, Australia. His research focuses on international climate change law and climate change law in China. Professor Zahar’s presentation challenged the use of human rights claims in climate mitigation lawsuits.

Gerd Winter: Armando Carvalho et al Versus European Union, called Peoples Climate Case: Litigation between Law, Science and Policy

Gerd Winter was a Professor of Law at the University of Bremen from 1973-2008. He has founded and directed the Research Center for European Environmental Law (FEU) until 2016 and has served as consultant on administrative and environmental law development in transition countries. At the conference, his presentation focused on the EU People’s Climate Case, in which he has been directly involved as a leading counsel for the plaintiffs.

Clémentine Baldon and Hugo Partouche: The French Climate Case: “The Case of the Century”

Clémentine Baldon and Hugo Partouche are both French lawyers representing two of the environmental NGOs (the Fondation Nicolas Hulot and Notre Affaire A Tous, respectively) in the climate lawsuit brought against the French government. In their presentation, Ms. Baldon and Mr. Partouche introduced their lawsuit, which they call “the case of the century”. They insisted on the large public mobilization campaign that was launched alongside the lawsuit, and detailed their litigation strategy aimed at forcing the government to implement the ambitious climate objectives it has set for itself.
